Update on EPBC Referral – proposed mining lease at Warramboo (Mining Act)

On 28 October 2014 Iron Road was advised by the Department of the Environment in Canberra that the referral document lodged in September 2014 relating to the proposed mine at Warramboo had been assessed and that the proposed action is not a ‘controlled action’.

This decision does not affect any other environmental approvals that Iron Road may be required to obtain pursuant to South Australian legislation.

 

EPBC Referral document submitted for the proposed mining lease at Warramboo (Mining Act)              

On 29 September 2014 Iron Road submitted a referral document to the Department of the Environment in Canberra under the Commonwealth Government’s Environmental Protection and Biodiversity Conservation Act 1999 (EPBC Act). The referral is in relation to the area to be covered by a proposed mining lease at Warramboo.

There is a statutory two week timeframe where the public can make submissions in relation to the referral. The referral document and information can be found here.

What is an EPBC Referral and how is this related to the CEIP?

A referral under the EPBC Act is an application to determine whether a particular action could have a significant impact on any listed matter of National Environmental Significance.  In the case of the referral document submitted in September 2014, the ‘action’ is the proposed development of the mining component of the CEIP such as the mine itself and all associated infrastructure within the proposed mining lease boundary.

Update on EPBC referral – CEIP infrastructure component (Development Act)

On 29 July 2014 Iron Road submitted a referral document to the Department of the Environment in relation to the infrastructure components of the CEIP such as the railway and deep sea port.

On 26 August 2014 Iron Road was advised that the Minister for Environment had determined that the proposed port at Cape Hardy was a ‘controlled action’ and will require an assessment to determine what impacts, if any, the shipping activities will have on the population of the Southern Right Whale.
